தமிழ்நாட்டில் பிராமணர்களுக்கு சமுதாய சான்றிதழ் வழங்க கோரி உயர்நீதி மன்றத்தில் பொது நல வழக்கு மனு தாக்கல் செய்ய பட்டுள்ளது.
மாநிலத்தில் உள்ள சமூகங்களின் பட்டியலில் பிராமணர்களை சேர்க்கவும், அவர்களுக்கு சமுதாய சான்றிதழ்களை வழங்கவும் ஒரு வேண்டுகோள் ஒன்றை சென்னை உயர் நீதிமன்றத்தில் தாக்கல் செய்யப்பட்டுள்ளது.
தலைமை நீதிபதி இந்திரா பானர்ஜி மற்றும் நீதிபதி அப்துல் குட்ஹோஸ் ஆகியோரின் தலைமையிலான பெஞ்ச் முன் வந்த பொதுநல வழக்கை நீதிபதி ஹுலவிதி ஜி.ரமேஷ் விசாரிக்க உத்தரவிட்டார்.
ஆந்திரா போன்ற அண்டை மாநிலங்களில் பிராமணர்களுக்கு சமுதாய சான்றிதழ் வழங்கப்படுகிறது என்று மனுதாரர் கூறியுள்ளார்.
சமுதாய சான்றிதழ்களை பிற சமூகங்களுக்கு வழங்கியபோது, அவர்கள் ஏன் பிராமண சமூகத்தின் விஷயத்தில் தரப்படவில்லை என்று கேள்வியெழுப்பியுள்ளார்.
அரசியலமைப்பின் படி பிராமணர்கள் சமூகம் என வகைப்படுத்தப்படாமலும், அவர்களுக்கு சமுதாய சான்றிதழ்கள் எழும் என்பதையும் தகவல் அறியும் உரிமைச் செயலர் செயலாளர், வருவாய் மற்றும் பேரழிவு முகாமைத்துவ திணைக்களம் கூறியதாக அவர் தெரிவித்தார்.
பிராமணர்களுக்கு சமுதாய சான்றிதழ்களை வழங்காமல் இருப்பது அரசாங்கம் தவறிழைக்கும் செயல் மேலும் இது சட்டவிரோதமானது மற்றும் நிலத்தின் சட்டத்திற்கு எதிரானது” என்று மனுதாரர் கூறினார்.
இது அரசியலமைப்பின் கீழ் உத்தரவாதமளிக்கப்பட்ட சமத்துவத்தின் அடிப்படை உரிமையை இது பாதிக்கிறது என்று அவர் கூறினார்.
மாநிலத்தில் உள்ள சமூகங்களின் பட்டியலிலும் பிற சாதிகளை போன்று பிராமணர்களுக்கும் சாதி சான்றிதழ்களை வழங்குவதற்காக அதிகாரிகளுக்கு உத்தரவிடுமாறு அந்த மனுவில் கோரியுள்ளார்.
Public interest litigation filed in Madras high court seeking to issue Community certificate for brahmins in Tamil nadu
A PIL petition has been recorded in the Madras high court looking for a course to the legislature to incorporate the Brahmins in the rundown of groups in the state and issue Community certificate to them.
At the point when the PIL recorded by advocate V Arunagiri came up for hearing yesterday, the first bench of Chief Justice Indira Banerjee and Justice Abdul Quddhose guided the registry to post it before the Honorable court headed by Justice Hulivadi G Ramesh on March 5.
The solicitor presented that neighboring states, for example, Andhra Pradesh were issuing Community certificate to the Brahmins.
At the point when Community certificate were given by govt authorities to different groups, why are they not being issued on account of the Brahmin Community, he inquired.
He presented that the Secretary, Revenue and Disaster Management Department, had in a RTI answer said the Brahmins were not a Community as indicated by state govt authorities and henceforth, the issue of Community certificate to them was denied.
The solicitor said the act of the state govt declining to give Community certificate to the Brahmins was “unlawful and illegal of the land”.
It additionally influenced the major right of equity ensured under the Constitution, he said.
He looked for a course to experts to incorporate the Brahmins as a community in the state and issue Community certificate to them.
