தாடி வைத்திருந்ததன் மூலம் சீக்கியர் என அடையாளம் கண்டு கொண்ட அமெரிக்கக் கார் நிறுவனம் ஒன்று, வேலை வேண்டி வந்தவருக்கு தாடியை எடுத்தால் வேலை தருவதாக நிபந்தனை விதித்தது. இதனை எதிர்த்து சம்பந்தப்பட்ட சீக்கியர் தொடர்ந்த வழக்கில், அவருக்கு ரூ31,25,500 லட்சம் இழப்பீடு கிடைத்துள்ளது.  அமெரிக்காவில் வசிக்கும் இந்திய வம்சா வழியை சேர்ந்த சீக்கியர் குர்ப்ரீத் கெர்ஹா. இவர் நியூஜெர்சி நகரில் உள்ள கார் டீலரிடம் வேலை வேண்டிச் சென்றார். நேர்முக தேர்வில் தேர்ச்சி பெற்ற கெர்ஹாவுக்கு, அந்த நிறுவனம் ஒரு முக்கிய நிபந்தனை விதித்தது. அதாவது, அவர், தனது தாடியை நீக்கிவிட்டு உடனடியாக பணியில் சேர்ந்து கொள்ளலாம் என்பது தான் அது. இதனைக் கேட்டு அதிர்ச்சியடைந்த கெர்ஹா, தன் மத சம்பிரதாயங்களை மீறியவகையில் தாடியை எடுக்க முடியாது என மறுத்து விட்டார். இதனால், அந்நிறுவனம் கெர்ஹாவிற்கு வேலை அளிக்க இயலாது என தெரிவித்து விட்டது. இச்சம்பவத்தைத் தொடர்ந்து கடந்த 2009ம் ஆண்டு, அமெரிக்காவில் வாழும் சீக்கியர் அமைப்புகள் ஒன்றிணைந்து கெர்ஹா சார்பில் நியூஜெர்சி கோர்ட்டில் வழக்கு தொடர்ந்தது. சமநீதி, சமஉரிமை கோட்பாடுகளை மீறிய வகையில் கார் டீலர் நிறுவனம் தன்னை வஞ்சித்து விட்டதாகவும், தனக்கு உரிய நிவாரணம் வழங்கப்பட வேண்டும் எனவும் கெர்ஹா தனது வாதத்தை முன்வைத்தார். கிட்டத்தட்ட 4 ஆண்டுகளாக நடந்துவந்த இந்த வழக்கு தற்போது இறுதி கட்டத்தை அடைந்துள்ளது. விரைவில் தீர்ப்பு வழங்கக்கப் படலாம் என எதிர்பார்க்கப் பட்டது. இந்நிலையில், திடீரென கெர்ஹாவுடன் சமரசம் செய்து கொள்ள விரும்புவதாக சம்பந்தப்பட்ட கார் நிறுவனம் தெரிவித்தது. அதனைத் தொடர்ந்து, பாதிக்கப்பட்ட கெர்ஹாவுக்கு 50 ஆயிரம் டாலர்கள் இழப்பீடு தருவதாகவும், வழக்கை வாபஸ் பெறுமாறும் கார்நிறுவனம் கேட்டுக் கொண்டது. அதனை ஏற்றுக் கொண்ட கெர்ஹா, ‘எனது தனிப்பட்ட நலனுக்காக நான் கோர்ட்டை அணுகவில்லை. எதிர்காலத்தில் இத்தகைய பாதிப்புக்கு உள்ளாகக்கூடிய அனைத்து சீக்கியரின் நலனுக்காகவும் நான் வாதாடி வெற்றி பெற்றுள்ளேன்’ எனத் தெரிவித்துள்ளார். மேலும், எதிர்காலத்தில் மதத்தின் அடிப்படையில் யார் மீதும் பாரபட்சம் காட்டக்கூடாது என கார் நிறுவனத்துக்கு நீதிமன்றம் அறிவுறுத்தியுள்ளது.

A Sikh man in the US will receive USD 50,000 as compensation to settle a religious discrimination lawsuit against a car dealership in New Jersey for denying him a job for maintaining a beard.   Gurpreet Kherha had filed a discrimination charge with the Equal Employment Opportunity Commission (EEOC) and a lawsuit in 2009 against Tri-County Lexus, where he had applied for a position as a sales associate and was qualified for the job.   EEOC said after the car dealership requested Kherha to shave his beard, he refused to comply due to his religious beliefs.   The dealership denied him the job, the agency charged.According to the lawsuit, Tri-County Lexus had a “no-beard” policy for sales and administrative personnel and it strictly enforced its dress code policy without granting reasonable religious accommodations.   The lawsuit was filed on behalf of Kherha by rights group Sikh Coalition and the EEOC.   Under the settlement reached in the case, the car dealership would pay USD 50,000 to Kherha and the firm has been urged not to discriminate on the basis of?religion in future.   Tri-County has also entered into a two-year consent decree with the federal government under which it is required to undertake a series of “remedial”?measures including revising its written policies and procedures prohibiting employment discrimination and providing anti-discrimination training to employees and management.   It is also required to post a notice regarding the resolution of the lawsuit.
