சேது சமுத்திர கால்வாய்த் திட்டத்தை செயல்படுத்த அனுமதி கோரி உச்ச நீதிமன்றத்தில் மத்திய கப்பல் அமைச்சகம் திங்கள்கிழமை மனு தாக்கல் செய்தது.

இத் திட்டத்துக்கு எதிராக தொடரப்பட்டுள்ள மனுக்களை தள்ளுபடி செய்ய வேண்டும் என்றும் அந்த மனுவில் மத்திய அரசு கோரியுள்ளது.

இத் திட்டத்தை எதிர்த்து ஏற்கெனவே தமிழக அரசு, முதல்வர் ஜெயலலிதா, பாஜக மூத்த தலைவர் சுப்பிரமணியன் சுவாமி, விஸ்வ ஹிந்து பரிஷத் உள்ளிட்ட அமைப்புகள் உச்ச நீதிமன்றத்தில் தொடர்ந்த வழக்கு உச்ச நீதிமன்றத்தில் செவ்வாய்க்கிழமை விசாரணைக்கு வரவுள்ளது. அப்போது மத்திய கப்பல் துறையின் மனுவும் விசாரணைக்கு ஏற்றுக்கொள்ளப்படும் என எதிர்பார்க்கப்படுகிறது.

சேது சமுத்திர கால்வாய்த் திட்டம் தொடர்பாக மத்திய கப்பல் அமைச்சக துணைச் செயலர் அனந்த் கிஷோர் சரண் தாக்கல் செய்த மனுவின் விவரம்: சேது திட்டம் செயல்படுத்தப்படும் பகுதியில் பருவநிலை, சுற்றுச்சூழல், புவியியல் ஆகியவை தொடர்பாக எல்லா பருவநிலைகளில் மிகவும் ஆழ்ந்து ஆய்வு நடத்த வேண்டும் என்று ஆர்.கே. பச்சௌரி குழு அறிக்கையில் கூறியுள்ளது.

தமிழக அரசு வாதம் தவறு: சேது திட்டம் செயல்படுத்தப்படும் பகுதியில் ராமர் பாலம் இருப்பதாகக் கூறி அதை தேசிய புராதனச் சின்னமாக அறிவிக்க வேண்டும்’ என்று தமிழக அரசு கோருகிறது. ஆனால், அப் பகுதியில் தொல்லியல் ஆய்வுகள் நடத்தப்படவில்லை என்பதையும் இது தொடர்பான மத்திய அரசின் நிலை 2008-ஆம் ஆண்டிலேயே தெளிவுபடுத்தப்பட்டுள்ளது என்பதையும் சுட்டிக்காட்ட விரும்புகிறோம். எனவே, இத் திட்டத்துக்கு எதிராக தொடரப்பட்டுள்ள மனுக்களை தள்ளுபடி செய்ய வேண்டும்’ என்று மனுவில் குறிப்பிடப்பட்டுள்ளது.

சேது சமுத்திர கால்வாய்த் திட்டம் தொடர்பாக மத்திய அரசு கடந்த பிப்ரவரி 22-ஆம் தேதி மனு தாக்கல் செய்தது. மாற்றுப் பாதையில் சேது சமுத்திர திட்டம் சாத்தியமில்லை என்றும் சுற்றுச்சூழல், பொருளாதாரம், நீரியல், புவியியல் ரீதியாக அத்திட்டம் பயன் தராது என்றும் சுற்றுச்சூழல் நிபுணர் ஆர்.கே. பச்சௌரி குழு அளித்த அறிக்கையை அரசு நிராகரிக்கிறது என்றும் அதில் கூறப்பட்டிருந்தது.

இதையடுத்து, இந்த வழக்கில் மனுதாரராகச் சேர்க்க கோரி, தமிழக அரசு விடுத்த வேண்டுகோளை கடந்த ஏப்ரலில் உச்ச நீதிமன்றம் ஏற்றுக் கொண்டது. அதன் பிறகு, கடந்த ஏப்ரல் 16-ஆம் தேதி தமிழக அரசு மனு தாக்கல் செய்தது. “சேது சமுத்திரத் திட்டத்தை செயல்படுத்தக் கூடாது’ என்று அதில் கோரப்பட்டது. அந்த மனுவுக்கு பதில் அளிக்கும்படி மத்திய அரசுக்கு நோட்டீஸ் அனுப்ப உச்ச நீதிமன்றம் கடந்த ஏப்ரல் 30-ஆம் தேதி உத்தரவிட்டது. இந் நிலையில், சேது கால்வாய்த் திட்டம் தொடர்பாக மத்திய கப்பல் அமைச்சகம் மேற்கண்ட மனுவை உச்ச நீதிமன்றத்தில் தாக்கல் செய்துள்ளது.

The Centre has brushed aside the objections raised by the Tamil Nadu Government against the Rs 25,000 crore Sethusamudram shipping channel project by telling the Supreme Court that it intends to go ahead with the venture as the expert panel headed by RK Pachauri has not come out with tenable and scientific data. Tamil Nadu government had said that the controversial project should be scrapped and the Centre should accept the Committee report that has found the entire project unviable on two fronts — economically and ecologically. In response to the contention of the state government that the project would adversely affect marine biodiversity and the Centre be directed to declare Ram Sethu as a national monument, the Centre submitted that environmental clearance to it was granted only after a careful examination of all relevant factors and the project would prove to be beneficial in public interest and economic terms. The affidavit by Ministry of Shipping said, “The summary report has provided detailed guidelines for mitigation, including after the project is constructed, fully suggesting the project will be green-lighted. “Yet, inexplicably, the committee concludes that the project is not viable. Conclusions are neither derived from nor supported by detailed scientific studies conducted by them,” it said. The affidavit further said the committee arbitrarily and contrary to the findings of its own studies concluded that the project is not viable. “Clearly, the recommendations of the committee are not tenable and are not supported by the scientific data and by the environmental studies commissioned by it,” it said. The Centre said the committee’s conclusion that Alignment 4A (an alternative route suggested by the court as against the original Alignment 6 which will cut through Ram Sethu) was not acceptable, was not supported by detailed studies. Tamil Nadu’s demand to declare the Ram Sethu/Adam’s Bridge, located southeast of Rameswaram near Pamban in Tamil Nadu, as a national monument did not find favour with the Centre. “The committee of eminent persons constituted in 2007 has exhaustively studied the case for and against the project and has noted that no archaeological study has been undertaken in the Ram Sethu/Adam’s Bridge area by the Archaeological Survey of India,” the affidavit claimed.
